TOPIC : MRP Base Excise Duty Rules And MRP Label Rules

Respected Sir,
I want to import spark plugs and other auto parts from Singapore, Japan, Thailand and UK. and want to stick MRP label as per rules. I want to know that what will be excise duty, after how much import value i have to pay excise duty, and where to register for that , and what is the rules of legal metrology department for MRP labeling and storage.

There is no excise duty ceiling. There is no requirement of registration under the Customs Act, 1962. The importer is required, under Section 46, to submit to the customs officer concerned a bill of entry as and when the goods enter India for assessment of excise duty.

Under the Legal Metrology (Packaged Commodities) Rules, 2011, for any imported package the following information need to be mentioned on every package.

The name and address of the importer.
Month and year of import.
The common or generic names of the commodity
The net quantity or the number of the commodity
The retail sale price of the package
the name, address, telephone number, e mail address, if available, of the person who can be or the office which can be, contacted, in case of consumer complaints.

Every declaration should be legible and prominent and the numerals of the retail sale price and net quantity declaration shall be printed on the package in a colour that contrasts the background of the label. The declaration has to be in either Hindi in Devanagari Script or English. Any other language maybe used, but only in addition to Hindi and English. If the dimensions and weight of a commodity has a relationship to the price of that commodity, then that information also need to be printed. No importer can sell the product at a price exceeding the retail sale price.

Every individual, firm, company or corporation who or which imports any commodity for sale, distribution or delivery shall make an application, accompanied by a fee of rupees five hundred, to the Director or the Controller for the registration. The application should contain the following details:

(a) the name of the applicant;

(b) the complete address of the premises at which the import of commodities is made by the applicant; and

(c) the name of the commodity or commodities imported by the applicant.

The activity mentioned by you amounts to trading in plain words and is eligible for refund of SAD upto 4% paid by you. However, the tricky part is labelling and relabeling which may amount to 'deemed manufacture' under prevalent Excise rules wherein you can take CENVAT of the duty paid.
